Notification regarding Document Verification of Candidates for Class-IV posts under the Provisions of Jammu and Kashmir Appointment to Class-IV (Special Recruitment Rules 2020) for filling up of leftover vacancies-2nd phase thereof.
Whereas, the General Administration Department vide Indent No. GAD/Mtg/RB-IV/50/2020 dated 22.06.2020 requisitioned 8575 Class-IV posts pertaining to various departments for recruitment in accordance with the Provisions of Jammu and Kashmir Appointment to Class-IV (Special Recruitment Rules 2020) notified vide SO 184 of 04.06.2020 read with SO 193 dated 17.06.2020 and other relevant rules governing the subject; and
Whereas, SO 184 of 2020 dated 04.06.2020 read with SRO 99 of
2008 dated 07.04.2008 envisages that the minimum and the maximum qualification for appointment to Class-IV posts under direct recruitment shall be “Minimum Matric and maximum 10+2”; and
Whereas, the aforesaid 8575 Class-IV posts for District/Divisional/
Union Territory Cadres in various Departments were advertised by the JKSSB vide Advertisement Notification No. 01 of 2020 dated 26.06.2020; and
Whereas, the Para 6 (i) of said Advertisement Notification provides that the selections under this advertisement Notification shall be in accordance with the provisions of Jammu and Kashmir Appointment to Class-IV (Special Recruitment Rules 2020) as notified vide SO 184 of 04.06 2020 read with SO 193 dated 17.06.2020 and para 6 (iii) provides that any candidate having his/her qualification other than prescribed shall not be eligible for Class-IV posts; and
Whereas, the sub rule (3) of rule 5 provides that the written test shall
be conducted for making selections to Class-IV posts to UT Cadre/Divisional Cadre/District Cadre; and
Whereas, the JKSSB conducted OMR based written test for aforementioned posts in three batches on 27th, 28th February, 2021 & 1st of March, 2021 and tentative merit/score of candidates who appeared in the said examination was notified vide Notification No. SSB/Secy/ClassIV/2021/3951-59 dated 25.05.2021; and
Whereas, rule 5 (5) of SO 184 of 2020 read with amendment notified
vide SO 193 dated 17.06.2020 provides that preferences are to be sought from the candidates in regard to the allocation of cadres in favour of selected candidates and accordingly the JKSSB vide Notice No. SSB/COE/PAA/2021/2986-94 dated 25.03.2021 called all such candidates who appeared in the written test examination, to furnish their preferences from 26.03.2021 to 01.04.2021, which was subsequently extended upto 02.05.2021 vide Notice No. SSB/COE/PAA/2021/3586-94 dated 23.04.2021; and
Whereas, in order to make the selections to the posts of Class-IV,
9652 candidates were called for counselling-cum-document verification vide Notice No. SSB/Secy/Sel/Class-IV/2021/4832-39 dated 07.07.2021 for verification of requisite documents to determine eligibility in light of prescribed qualification and entitlement for additional points both at Jammu and Srinagar; and
Whereas, another opportunity was also given to these shortlisted candidates who failed to appear before the Document Verification Committees to appear for document verification before the designated officers both at Jammu and Srinagar vide this Notice No. SSB/Secy/Sel/Class-IV/2021/6001-12 dated 08.09.2021; and
Whereas, some of the candidates has also approached the Hon’ble Tribunal and filed O.A 61/517/2020 titled N. K. Tripathi and others V/s UT of J&K and others for seeking quashment of condition 6 (iii) of advertisement Notification. The Hon’ble Central Administrative Tribunal Jammu was pleased to dismiss the above said OA vide judgment dated 28.07.2021, the operative part whereof is reproduced as under:
“…We do not find any reason to quash condition No. 6 (iii) of the Advertisement Notice No. 01 of 2020 dated 22.06.2020 issued by JKSSB. Accordingly, the O.A. is dismissed”; and
Whereas, the JKSSB also deemed it fit to seek from the shortlisted candidates an undertaking duly attested by the judicial magistrate 1st Class to the effect that they do not possess higher than the prescribed qualification and vide Notice No. SSB/Secy/Sel/Class-IV/2021/4832-39 dated 07.07.2021 asked the shortlisted candidates to produce the same in the Board/Document Verification Committee; and....
